Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kya Software website, applications and related services, including My Diary and My Life (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

If you do not agree to these Terms, you should not use the Services.

1. About Kya Software

Kya Software is an independent software business based in France that develops applications and digital services.

These Terms apply to Kya Software Services unless a particular application or service provides additional terms that expressly apply to it.

2. Using our Services

You may use the Services only in accordance with these Terms and applicable laws and regulations.

You are responsible for how you use the Services and for the information and content you choose to create, upload, save or otherwise provide through them.

Certain features may require access to device capabilities or permissions. You remain in control of permissions made available through your device settings.

3. Accounts

Some Kya Software applications may require or allow you to create an account.

You are responsible for keeping your login credentials, password, PIN and other account security information confidential and for taking reasonable steps to protect access to your account.

You should provide accurate information where information is required for an account or service and keep it reasonably up to date.

If you believe that your account has been accessed without authorization, you should contact Kya Software as soon as reasonably possible.

4. Your content

You retain ownership of the personal content you create within Kya Software applications.

Kya Software does not claim ownership of your diary entries, notes, goals, personal records or other content merely because you use our Services.

Where storage, synchronization or another feature requires technical processing of your content, Kya Software and its service providers may process that content only to the extent necessary to provide, secure and operate the relevant feature, subject to our Privacy Policy.

5. Premium features and subscriptions

Some Kya Software applications may provide optional Premium features through paid subscriptions or other purchases.

Before completing a purchase, the relevant application and the App Store will display the applicable product, subscription period and price.

Subscriptions purchased through a Kya Software iOS application are processed by Apple through the App Store and are subject to the applicable App Store payment and subscription terms.

Auto-renewable subscriptions renew automatically unless they are cancelled in accordance with the rules and deadlines displayed by Apple for your subscription.

You can manage or cancel an App Store subscription through your Apple account subscription settings.

Where supported by the application, previously purchased eligible subscriptions can be restored using the Restore Purchases option.

6. Free trials and introductory offers

Certain subscriptions may include a free trial or another introductory offer for eligible users.

The availability, duration, eligibility requirements and conditions of an introductory offer are displayed before purchase.

Unless cancelled before the end of an applicable free trial, a subscription may automatically convert to a paid subscription at the price displayed when the subscription is started, subject to Apple's applicable subscription terms.

Eligibility for introductory offers may be determined by the App Store and may depend on previous subscriptions or offers associated with the relevant subscription group.

7. Prices, billing and refunds

Prices may vary depending on the application, subscription, country, currency, applicable taxes and App Store storefront. The price presented to you before confirming a purchase is the applicable price for that transaction.

For purchases processed through the App Store, billing is handled by Apple using the payment method associated with your Apple account.

Requests for refunds relating to purchases processed by Apple are handled in accordance with Apple's applicable refund processes and your rights under applicable consumer law.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded or restricted.

8. Acceptable use

You agree not to misuse the Services. In particular, you must not:

• Use the Services for unlawful or fraudulent purposes.
• Attempt to gain unauthorized access to accounts, systems, servers or data.
• Intentionally interfere with, damage, overload or disrupt the Services or their infrastructure.
• Attempt to bypass security measures or access restrictions.
• Use automated methods to abuse, attack or materially disrupt the Services.
• Use the Services in a manner that infringes the rights of another person or violates applicable law.

9. Intellectual property

The Kya Software name, branding, website, application designs, interfaces, graphics, software and other materials provided by Kya Software are protected by applicable intellectual property laws.

Except where expressly permitted, these materials may not be copied, reproduced, distributed, sold, licensed or used to create derivative products without authorization.

This section does not affect your ownership of personal content that you create within the Services.

10. Third-party services

Some features may rely on or interact with third-party services, including hosting, cloud infrastructure, authentication, email delivery, application distribution or payment services.

Your use of a third-party service may also be subject to that provider's own terms and privacy practices.

11. Availability and changes to the Services

We aim to keep the Services available, reliable and secure, but uninterrupted or error-free operation cannot be guaranteed.

Services may occasionally be unavailable because of maintenance, updates, technical problems, security measures or circumstances outside our reasonable control.

Kya Software may update, improve, modify or discontinue features as its applications evolve.

Where required by applicable law, users will be provided with appropriate information about material changes affecting their rights or paid Services.

12. Personal wellbeing features

Some Kya Software applications may include features relating to personal organization, wellbeing, habits, food, movement, goals, reflections or similar areas of daily life.

These features are provided for general informational, organizational and personal-use purposes. They are not intended to provide medical diagnosis, treatment or professional medical advice.

You should not rely on a Kya Software application as a substitute for advice from an appropriately qualified professional where professional advice is required.

13. Security and backups

Kya Software takes reasonable measures designed to protect its Services and the information processed through them.

However, no electronic system, storage method or internet transmission can be guaranteed to be completely secure or permanently available.

Where an application provides export, backup or synchronization functionality, users are encouraged to make reasonable use of those features for information that is important to them.

14. Suspension or termination

Access to all or part of the Services may be restricted or suspended where reasonably necessary to protect users, security or infrastructure, to investigate misuse, to comply with legal obligations, or in response to a serious violation of these Terms.

Any such action will remain subject to rights and protections provided by applicable law.

15. Limitation of liability

To the extent permitted by applicable law, Kya Software is not responsible for indirect losses that were not reasonably foreseeable or for losses resulting from circumstances outside its reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms excludes, restricts or waives mandatory rights or remedies available to consumers under applicable French or European Union law.

16. Privacy

The processing of personal information in connection with the Services is described in our Privacy Policy.

17. Changes to these Terms

We may update these Terms when our Services, features, business practices or legal obligations change.

The current version will be published on this page and the "Last updated" date will be revised when changes are made.

Where required by applicable law, additional notice will be provided before a material change takes effect.

18. Governing law and consumer rights

These Terms are governed by French law, without depriving consumers of any mandatory protections granted to them by the law applicable in their country of residence.

Any dispute relating to the Services will be handled in accordance with applicable jurisdiction and consumer-protection rules.
